Terms of Service

These Terms govern your access to and use of sendvia.chat, a service for sending transactional and operational messages, including login codes, magic links, contact alerts, booking updates, and appointment reminders through WhatsApp, Telegram, and SMS authentication fallback.

Please read these Terms carefully. By accessing or using sendvia.chat, you agree to these Terms. If you use sendvia.chat for a company, you confirm that you are authorized to bind that company.

1. The Service

sendvia.chat helps developers and businesses deliver transactional messages through connected WhatsApp or Telegram accounts, with optional SMS fallback for authentication workflows where configured.

sendvia.chat is not a telecommunications carrier, payment processor, emergency communication service, or legal compliance adviser. Delivery depends on your configuration and on third-party networks and platforms.

2. Accounts and Access

  • You must provide accurate account and contact information.
  • You are responsible for keeping your account, sessions, connected devices, API keys, and dashboard access secure.
  • You may connect only WhatsApp, Telegram, SMS, and application resources that you are authorized to use.
  • You must rotate credentials promptly if they are exposed or compromised.

3. Permitted Use

You may use sendvia.chat only for lawful transactional and operational messages that recipients requested, initiated, or can reasonably expect, such as login codes, magic links, booking updates, appointment reminders, product notifications, and contact-us alerts.

  • Do not use the service for spam, phishing, fraud, harassment, or abuse.
  • Do not use the service for cold outreach, scraped-number messaging, purchased lists, rented lists, or bulk promotional campaigns.
  • Do not send unlawful, misleading, harmful, or discriminatory content.
  • Do not send messages to people who have opted out, withdrawn consent, or asked not to be contacted.
  • Do not interfere with the service, bypass rate limits, probe security controls, or overload third-party networks.
  • Do not use sendvia.chat for emergency calls, emergency alerts, or other life-safety communications.

4. Recipient Data and Consent

You are responsible for having a lawful basis to send recipient phone numbers, chat identifiers, messages, and related data to sendvia.chat. You are also responsible for recipient notices, consent, opt-out handling, and compliance with messaging rules that apply to your use case.

For WhatsApp messages, recipients must have provided their phone number and agreed to receive messages from your business where required by law or platform policy. You must keep proof of opt-in when it is required and must honor opt-out, unsubscribe, STOP, and similar requests promptly.

You decide which recipients are contacted and what content is sent. You are responsible for making sure each message is expected, relevant, lawful, and allowed by WhatsApp, Telegram, SMS, telecom, consumer-protection, and privacy rules that apply to you.

5. Third-Party Platforms

sendvia.chat depends on third-party platforms and providers, including WhatsApp, Telegram, SMS providers, hosting, analytics, payment, and email services. Those providers may change APIs, policies, limits, prices, or availability.

We are not responsible for message rejection, account restrictions, delivery delays, outages, or policy decisions made by third-party providers.

WhatsApp and other messaging platforms may restrict, rate-limit, disconnect, suspend, or ban accounts or numbers that they believe violate their policies, receive poor recipient feedback, send unwanted messages, or use automation in a way they do not allow. This can happen even if sendvia.chat is technically operating correctly.

sendvia.chat does not guarantee that a connected WhatsApp, Telegram, or SMS account will remain available, unrestricted, or eligible for all message types. You are responsible for reviewing and following the terms, policies, template rules, business messaging rules, and consent requirements of each platform you use.

6. Data Protection and Processing

For recipient data and message content that you submit through the service, you usually act as the controller or business that decides the purpose and means of processing. sendvia.chat processes that data to provide, secure, monitor, debug, bill, support, and improve the service, as described in our Privacy Policy and GDPR information.

Processing may include recipient phone numbers, chat identifiers, message content, timestamps, delivery status, API metadata, connected-device status, billing records, support records, and security logs. You must not send sensitive personal data unless you have a valid legal basis and appropriate safeguards.

We use subprocessors and third-party providers such as hosting, database, email, billing, analytics where enabled, WhatsApp, Telegram, and SMS providers. Where personal data is transferred internationally, you are responsible for assessing whether your use case requires additional contractual or regulatory safeguards.

We retain personal data only as long as needed for service operation, delivery logs, billing, support, security, abuse prevention, disputes, and legal obligations, then delete or anonymize it where technically and legally possible.

7. Availability and Changes

We work to keep sendvia.chat reliable, but the service may be unavailable during maintenance, incidents, provider outages, abuse prevention, or changes required for security or compliance.

We may update features, APIs, pricing, limits, supported providers, or these Terms as the product evolves.

8. Fees

Paid plans, free trials, renewals, limits, and cancellations are governed by the pricing or order terms shown at checkout, in the billing area, or in a written agreement. Prices are generally exclusive of taxes unless stated otherwise.

9. Intellectual Property

sendvia.chat, its software, design, documentation, APIs, workflows, and brand assets are owned by us or our licensors. You retain ownership of your business data and recipient data, while granting us the rights needed to process it to provide and protect the service.

10. Limitation of Liability

To the maximum extent permitted by law, sendvia.chat is provided without warranties of uninterrupted, error-free, or guaranteed delivery. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by incorrect configuration, third-party services, provider restrictions, or unlawful customer use.

You are responsible for claims, complaints, fines, investigations, platform enforcement, number bans, account restrictions, or losses that arise from messages you send, missing consent, unlawful content, ignored opt-outs, or violation of third-party platform rules.
